1. Acceptance of terms
By creating an account or using TorqOS, you agree to these Terms of Service. If you do not agree, do not use the service.
2. The service
TorqOS provides software services for independent tire and auto repair shops, including but not limited to the TorqOS Tire POS product (sales, cash drawer, payment tracking, reporting, and exports) and future modules described on the TorqOS website. TorqOS is provided as a software-as-a-service subscription and is accessed online — no physical products are shipped.
3. Accounts and user responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information when registering and keep it up to date. Owners are responsible for the actions of users they invite to their shop tenant, including advisors and technicians.
4. Subscription, trial, and billing
TorqOS Tire POS is offered on a paid subscription. New subscriptions begin with a 7-day free trial. A payment card is required to start the trial. You will not be charged during the trial. After the trial ends, the subscription automatically begins at the published monthly rate unless you cancel before the trial ends. Subscriptions then renew each month until canceled. Payments are processed by Stripe.
5. Cancellation and refunds
You may cancel your subscription at any time through the Stripe billing portal accessible from the TorqOS application, or by contacting support@torqos.app. Monthly subscription fees are generally non-refundable once billed, except where required by law. 6. Acceptable use
You agree not to:
- Use TorqOS for any unlawful purpose or in violation of these terms.
- Attempt to gain unauthorized access to other tenants, systems, or accounts.
- Probe, scan, or test the vulnerability of any TorqOS system without prior written permission.
- Reverse engineer, decompile, or attempt to derive source code from the service.
- Misrepresent your identity, business, or affiliation with TorqOS.
7. Service availability
TorqOS works to keep the service available and reliable but does not guarantee uninterrupted availability. Scheduled maintenance, upgrades, third-party outages (including Supabase, Stripe, and other infrastructure providers), or other events may cause interruptions. TorqOS is not liable for losses arising from temporary unavailability.
8. Data and exports
You own your data. TorqOS provides exports (such as CSV reports) so you can take your records with you. Upon cancellation, TorqOS retains data for a reasonable period to support potential reactivation and to comply with legal obligations.
9. Limitation of liability
To the maximum extent permitted by law, TorqOS, its affiliates, and suppliers are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenue arising from your use of the service. Total aggregate liability for any direct damages is limited to the amount you paid to TorqOS in the twelve months preceding the event giving rise to the claim.
10. Changes to the service or terms
TorqOS may modify the service or these terms from time to time. Material changes will be communicated through the application or by email when appropriate. Continued use of TorqOS after such changes constitutes acceptance of the updated terms.
11. Governing law
These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles.
